Terms of Service

1 Acceptance of Terms

By purchasing, downloading, activating, or using Spitari ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software. These Terms constitute a legally binding agreement between you and Spitari.

2 License Grant

Subject to your compliance with these Terms and payment of applicable fees, Spitari grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for personal use during the subscription period for which you have paid.

This license does not include:

• The right to sell, sublicense, rent, or distribute the Software or your license key to any other party
• The right to share, leak, or otherwise distribute your license key
• The right to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software
• The right to create derivative works based on the Software

3 Subscription Plans & Payments

Spitari offers several license tiers — Daily, Weekly, Monthly, and Lifetime — as described on our pricing page. All purchases are processed through Sellix or our designated payment processor.

• Non-refundable: All sales are final. Due to the digital nature of the Software and immediate access upon activation, we do not offer refunds under any circumstances.
• License binding: Your license key is bound to a single hardware fingerprint (HWID). Use on multiple machines simultaneously is not permitted.
• HWID resets: A limited number of HWID resets may be available via our Discord bot, subject to our cooldown policy.
• Expiry: Time-limited licenses expire at the end of their period. Lifetime licenses are valid for as long as the Software exists and is actively maintained.

4 Acceptable Use

You agree to use the Software only for personal entertainment purposes. You are solely responsible for ensuring that your use of the Software complies with all applicable laws in your jurisdiction and with the terms of any platforms or games with which you use it.

5 Prohibited Conduct

The following actions are strictly prohibited and will result in immediate license revocation without refund:

• Sharing, selling, or distributing your license key to any other person
• Attempting to bypass, crack, spoof, or tamper with the Software's authentication system
• Attempting to use a Freemium license key to access Premium features, or vice versa
• Using automated tools to generate, guess, or brute-force license keys
• Publicly distributing cracked, patched, or leaked versions of the Software
• Using the Software to harass, harm, or exploit other users in any game or platform
• Attempting to disrupt or attack Spitari's servers, APIs, or infrastructure
• Impersonating Spitari staff or representatives

6 License Revocation

Spitari reserves the right to revoke, suspend, or ban any license at our sole discretion if we determine that a user has violated these Terms. Revoked licenses are non-refundable. We may also permanently ban a hardware ID or Discord account from future purchases.

7 Updates & Availability

Spitari may push automatic updates to the Software at any time. Continued use of the Software constitutes acceptance of any updates. We reserve the right to modify, suspend, or discontinue the Software or any feature at any time, with or without notice. Spitari is not liable for any interruption in service or feature availability.

We do not guarantee uptime, compatibility with any specific game version, or that the Software will remain undetected by anti-cheat systems at any time.

8 Disclaimer of Warranties

The Software is provided "as is" and "as available" without any warranty of any kind, express or implied. Spitari makes no representations or warranties regarding:

• The accuracy, reliability, or completeness of the Software
• That the Software will be uninterrupted, error-free, or secure
• That the Software will remain undetected by any anti-cheat, anti-tamper, or security system
• Fitness for any particular purpose

Your use of the Software is entirely at your own risk.

9 Limitation of Liability

To the fullest extent permitted by applicable law, Spitari and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of game accounts, progress, virtual items, or in-game currency
• Bans, suspensions, or penalties issued by any game or platform
• Any data loss or corruption
• Any lost profits or revenue

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the Software in the 30 days preceding the claim.

10 Indemnification

You agree to indemnify, defend, and hold harmless Spitari and its operators from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with your use of the Software, your violation of these Terms, or your violation of any applicable law or third-party rights.

11 Intellectual Property

All rights, title, and interest in the Software, including all source code, binaries, graphics, user interface elements, and associated documentation, are and remain the exclusive property of Spitari. Nothing in these Terms transfers any intellectual property rights to you. All rights not expressly granted are reserved.

12 Age Restriction

You must be at least 13 years of age to purchase or use the Software. By using Spitari, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you must have parental or legal guardian consent.

13 Changes to These Terms

Spitari reserves the right to modify these Terms at any time. We will notify users of material changes via our Discord server. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Software after changes are posted constitutes your acceptance of the updated Terms.

14 Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes will be submitted to binding arbitration under the rules of a recognized arbitration body.
